ASTA KASK press release - Dadde - 2006-09-28 15:31:36

September 28 2006

ASTA KASK STOPPED BY RECORD LABEL

What have happened?

One of Sweden's oldest and biggest punkband - Asta Kask- are running the risk of being sued for using our own name! XXX*, representative for the band's previous record label Rosa Honung, have though his company 1000 db, registrated the trademark Asta Kask.

Why?

Asta Kask have lost all our confidence for XXX after many years of collaboration. Due to questionable distribution, bad co-operation, very questionable annual reports, poor promotion for the band and our records and alot of failed promises from Rosa Honung, the band decided to sign with Burning Heart Records during the spring of 2006. The early releases, originally released on Rosa Honung Records, with recordings financed by Asta Kask, was brought over to Burning heart for planned re-issues. XXX, who now feelt swindled on the goods, contacted us through his legal representative with threats of legal measures regarding us trespassing his copyright. XXX also informed us that he as early as the summer of 2003 had registrated the trademark Asta Kask as his own. And now he's using it as a weapon against us.

Asta Kask had been releasing records and played under the name long before we got to known XXX, and we feel that we have every right in the world to use our own name. Despite this XXX have been able to, through a simple copyright registration, almost stop the re-issues of our own recordings, a completly new album for Burning Heart Records, as well as a documentary-DVD, that was filmed in 2003 by two freelance directors.

When Asta Kask got aware of the registration (done 2003), in the summer of 2006, we of course immidiatly demanded the rights to our name back.

XXX then tells us that it is fine by him on the condition that the already printed CDs are destroyed and that they will be released trough Rosa Honung instead. Asta Kask would also be forced to sign a contract regarding the rights to the recordings to get access to our own name again. Since there's never been a valid contract between the band and Rosa Honung during the 20 years of "cooperation", Asta Kask of course refuse to sign any contracts now when XXX is working his way through using pure mafia methods and blackmail! The promised releases are now extremly delayed and our fans are furious.

Despite XXX's criminal methods, we tried through our legal representative Kristina Tunkrans to save the release of our new album as fast as possible by trying to negotiate and give XXX different economical proposals so that we can continue using our own name. XXX refuse to agree on any of our proposals and all the negotiations are dropped.

What are we doing now?

We're tired of this mess! As straight-backed as we possible can be we now make this filthy story public and let everybody know that we will go on an release our new album "En för alla, ingen för nån(One for all, no one for none)" and the documentary-DVD "Dom Får Aldrig Mig(They will never get me)" on Burning Heart Records. Releasedate for Scandinavia and Europe is set for the 15th of November. With that we now risk to get a lawsuit by the owner of the copyright Asta Kask's owner XXX. But we are not scared, and look forward for a possible summons! Can it really be legal to act like XXX have done towards Asta Kask? We don't think so and sure hope not. We also hope that this public announcement will lead so that young bands that plan to work with a label make proper agreements and ask for proffessional guidence before doing so. Or you risk to be ripped-off the way we have.

In november Asta will do a week long tour of Japan and plan to tour the USA and Brazil in the future. The new album "En för alla ingen för nån" will be out in Japan for the tour on Wizzard in Vinyl. Release dates and label information regarding Vinyl versions, the US and Brazil will follow as soon as possible. Keep yourself updated at www.astakask.com, www.myspace.com/astakask and on the japan tour website: http://www.crispynuts-label.com/astakaskjptour.

Asta kask is entering studio Soundlab this weekend together with Matte from Millencolin and will record our first new studio album since the breakup in 1986. We are excited as hell - and a little bit nervous too, I'll have to admit that, but it's gonna be fun!
